Art.939 din N.C.C.<\/span><\/strong> prevede ca acela care poseda bunul altuia timp de 10 ani<\/span><\/strong>, in alte conditii decat cele ale posesiei de buna-credinta, poate dobandi dreptul de proprietate<\/span><\/strong>, in temeiul uzucapiunii. Viciile posesiei suspenda cursul uzucapiunii si in acest caz poate opera jonctiunea posesiilor.<\/p>\n

In situatia prescriptiilor achizitive incepute sub imperiul Decretului-lege nr.115\/1938 si implinite dupa intrarea in vigoare a Legii nr. 7\/1996, actiunile in constatarea dobandirii dreptului de proprietate prin uzucapiune in regim de carte funciara sunt guvernate de dispozitiile legii vechi, respectiv ale Decretului-lege nr. 115\/1938.<\/p>\n

Uzucapiunea este o sanctiune civila aplicabila adevaratului proprietar al unui imobil, ce lasa bunul sau in posesia unei terte persoane care face acte de posesie sub nume de proprietar, intr-un termen definit de lege.<\/span> Adevaratul proprietar este deci singura persoana ce ar putea face aparari impotriva posesorului neproprietar care pretinde dobandirea dreptului de proprietate prin intermediul prescriptiei achizitive. Astfel, numai adevaratul proprietar are calitatea procesuala pasiva in acest litigiu.<\/p>\n

In regim de carte funciara, nu este posibil a se dobandi, prin uzucapiune, dreptul de proprietate asupra constructiilor pretins edificate de detinator, fara autorizatie.<\/span><\/p>\n

Pentru a opera dobandirea proprietatii prin uzucapiune, conform art. 645 si art. 1837 Cod civil, trebuie indeplinite conditiile rezultand din art. 1846-1847 din acelasi cod, si anume exercitarea unei posesii utile. Posesia este utila daca este neintrerupta, netabulara, publica si exercitata sub nume de proprietar, conform art. 1846-1847 Cod civil.
In temeiul art. 1860 Cod civil, orice posesor posterior are facultatea, spre a putea invoca dobandirea dreptului de proprietate prin uzucapiune, sa uneasca posesiunea sa cu posesiunea autorului sau daca:
– intre acestia a existat un raport juridic;
– posesorul anterior nu a fost proprietarul imobilului.<\/p>\n
